Computer Forensics
Technology is an essential part of today’s litigation. Finding a single spreadsheet, e-mail or deleted file can be a daunting, but crucial task. An entire case may hinge on what can be discovered. Information may be discovered, from computer hard drives and backup tapes. Such as deleted, lost, hidden, encrypted and fragmented files.

Even Files that were createdbut never saved may be found. Having this information can help put the whole picture together.

Data Acquisition

Create forensics image of hard drive or loose Media.
Create working copy and secure original.

Standard Review Steps

Keyword search for 10-15 keywords over the hard drive
(any hits generating over 500 results revisit with counsel).
Extract email post office box and recover deleted email.
Keyword search for email post office box and extract all email with hits.
Review for Internet email activity and extract Internet email if relevant. Work with the client on search requirements.
Review for evidence of hard drive wipe.
Review for password protected or encrypted data.
Review for deleted data.

Standard Appearance
CD Label with Case Name – Law Firm Name – Evidence Number – Date – “Attorney Client Privileged”.
Copy for our case file with unique case number.
Letter describing the CD and stating the evidence number of the CD to go to counsel and copy in case file.
Note in evidence database.

Standard Report
Data burned to CD in the following structure:
User last name, first name (number if multiple hard drives)
Folder “File Listings” containing Web page listing with the following:
Web page will contain file name, file path, dates & times and if files were deleted.
   Folder “Keyword Search Results”
·         Subfolder – recovered deleted files
·         Subfolder – recovered fragmented files
·         Subfolder – active files
·         Subfolder – active email
·         Subfolder – deleted email
·         Subfolder – active internet email (if relevant)

John Pironti, Computer World, in his literary work titled, “Hackers Beating Efforts to Patch Software Flaws,” strategically points out that latency between patch release and deployment in many companies leaves them dangerously exposed.

Mr. Pironti’s observations are very accurate, together with the fact that viruses, spy ware, and firewalls are the culprits that leave a company vulnerable. However, it is also the holes in a company’s operating system that may result in a catastrophic hacking that could actually be the ruination for many organizations. When a company is hacked, what are the options available, and more specifically, what can be done to sustain the life of that company depending on the severity of the hacking?

Most companies have firewalls, but when was the last time that the applicable logs were checked to determine if hacking was taking place?
